Terms of Service

These Terms of Service (the “Terms”) govern your use of NumericalSolution (the “Application”) and of the websites numericalsolution.com and numericalsolution.dk, operated by Numerical Solution (the “Operator”, “we”, “us”). Please read them before using the Application.

Summary: Use the Application lawfully and do not attack or abuse it. Sign-in is through your own Google Account, which remains governed by Google's terms. Software we publish as open source is licensed under its own licence, which prevails over these Terms. The Application is provided free of charge and “as is” with no warranty, and our liability is excluded to the fullest extent the law allows. Danish law applies.

1. Acceptance of these Terms

By accessing or using the Application, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Application. If you are using the Application on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. The Application

The Application authenticates you via your Google Account and provides access to the signed-in areas of the Operator's websites and services. Features may be added, changed or withdrawn at any time, and parts of the Application may be experimental or offered for evaluation purposes.

3. Eligibility and accounts

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction if that age is higher, to use the Application.

Google Sign-In

Authentication is delegated to Google. Signing in requires a Google Account and your consent to share your basic profile information with the Application, as described in our Privacy Policy. Your Google Account remains subject to the Google Terms of Service, and we are not responsible for Google's services or for any suspension or termination of your Google Account.

Your responsibility

You are responsible for maintaining the security of the Google Account you use to sign in, and for all activity carried out through your signed-in session. You can revoke the Application's access at any time at myaccount.google.com/permissions.

Automated access is permitted only where we have documented an interface for it, and must respect any published rate limits and the directives in our robots.txt.

5. Intellectual property and software licensing

Open source software

Much of the software published by the Operator is free and open source. Where software is distributed under an open source licence — including the GNU General Public License v3 and the licences stated in the individual repositories at github.com/ncnielsen — that licence governs your rights in the software and prevails over these Terms to the extent of any conflict. Nothing in these Terms is intended to restrict rights granted to you by an applicable open source licence.

Site content and marks

Except where an open source licence or another notice applies, the content of the websites — text, papers, images, layout — and the Numerical Solution name and logo remain the property of the Operator. Our papers may be read, cited and quoted with attribution. You may not use our name or logo to imply endorsement of your product or service without written permission.

Your content

You retain ownership of any data or content you submit through the Application. You grant us the limited licence needed to process it in order to operate the features you are using. We claim no further rights in it.

6. Third-party services

The Application depends on third-party services, including Google for authentication and Amazon Web Services for hosting, and may link to third-party sites and repositories. We do not control those services, and their terms and privacy practices apply to your use of them. We are not responsible for third-party content, availability or conduct.

7. Availability

We aim to keep the Application available but offer no uptime guarantee. We may suspend, limit or discontinue the Application, in whole or in part, for maintenance, security or any other reason, with or without notice. We are not liable for any unavailability.

8. Disclaimer of warranties

The Application is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Application will be uninterrupted, secure or error-free, or that any computational result, numerical output or research material it produces is correct, complete or suitable for your purposes.

Numerical results require your own verification. Outputs of the Application must not be relied upon as the sole basis for any decision with safety, financial, medical, legal or engineering consequences. You are responsible for independently validating any result before acting on it.

9. Limitation of liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profit, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of or inability to use the Application, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

The Application is provided free of charge. Accordingly, to the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or the Application is excluded in full and shall not exceed EUR 0.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or intentional misconduct. If you are a consumer, these Terms do not affect your mandatory statutory rights under the law of your country of residence.

10. Indemnity

You agree to indemnify and hold the Operator harmless against any claim, liability, loss or expense, including reasonable legal fees, arising from your breach of these Terms or your unlawful use of the Application. This section does not apply to consumers where it would be contrary to applicable mandatory consumer law.

11. Suspension and termination

You may stop using the Application at any time by signing out and revoking access to your Google Account as described in section 3. We may suspend or terminate your access without notice if we reasonably believe you have breached these Terms, or if we are required to do so by law or by the terms of a service we depend on. Sections 5, 8, 9, 10, 12 and 13 survive termination.

12. Changes to these Terms

We may revise these Terms to reflect changes in the Application or in applicable law. The “Last updated” date above always shows the current version, which remains available at https://numericalsolution.com/terms.html. Material changes take effect when published here; continuing to use the Application after that point constitutes acceptance. If you do not accept a revision, stop using the Application.

13. Governing law and disputes

These Terms are governed by the laws of Denmark, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. The courts of Denmark have exclusive jurisdiction over any dispute arising out of these Terms. If you are a consumer resident in the European Union, you retain the right to bring proceedings in, and to the protection of the mandatory law of, your country of residence.
